1. The agreement
These terms are an agreement between you and Agent Creative (“we”), the operator of AdBatch. By using the website or the tool you accept them. If you use AdBatch for a company, you accept them for that company.
2. What AdBatch does
AdBatch turns a product photo and a short description into advertising images and text that you download. It does not publish ads, connect to advertising accounts or manage campaigns. We do not promise that ads made with AdBatch will achieve any particular result, such as sales, clicks or approval by an advertising platform.
3. Accounts
You can try the tool without an account. An account is needed to save projects and to download files. Keep your password private; you are responsible for what is done under your account. Tell us through the Contact page if you think someone else has access to it. You must be old enough to enter a contract where you live.
4. Plans, exports and payment
- Free plan. Includes a monthly number of exports, shown on the Pricing page. Free exports may carry a small corner mark.
- Pro plan. A monthly subscription, charged in advance through Stripe and renewed each month until canceled. When a subscription ends, the account returns to the Free plan; saved projects and brand kits remain in the account.
- Export packs. A one-off purchase of export credits. Credits are used before the monthly allowance.
- Counting. One downloaded image file is one export. Making, previewing and adjusting ads is not counted. Where AI backgrounds are available they are counted separately, and only when a picture has been delivered.
Prices are shown on the Pricing page and at checkout. We may change prices or allowances for future billing periods and will say so on the site before the change applies. Taxes may be added where required.
5. Refunds
If something went wrong with a payment, or the service did not work for you, write to us through the Contact page within 14 days of the charge and we will put it right or refund it. Unused time on a subscription is not otherwise refunded when you cancel.
6. Your content
Your photos, logos, product details and the ads you make are yours. You give us permission to store and process them only as needed to run the service for you, for example saving a project so you can reopen it. We do not claim ownership of your ads, and we do not use your content for advertising or to train AI models.
You are responsible for what you upload and publish. You confirm that you have the right to use each photo, logo and trademark you put into AdBatch, and that the claims in your ads (prices, offers, product statements) are true and lawful where you publish them.
7. Generated text and AI features
Headlines and captions are produced from the details you enter, by built-in formulas or, where switched on, by an AI model. Read every line before you publish it: you decide what your ad says. AI features, where available, send the content described in the Privacy Policy to a third-party provider, can fail or be unavailable, and their output may resemble output given to other users.
8. Fonts and example material
The fonts drawn into your ads are open-license typefaces that may be used in commercial images. The example project, its photo and the brand name in it are samples for demonstration.
9. Acceptable use
Do not use AdBatch to make content that is unlawful, deceptive, infringing or harmful; do not try to break, overload or bypass the limits of the service; do not access other people's accounts or data; do not resell access to the service without our agreement.
10. Our rights
The AdBatch software, the layouts as a system, this website and its design belong to Agent Creative or its licensors. These terms do not transfer them to you. The images you export are yours to use.
11. Availability and changes
We work to keep AdBatch available but do not guarantee uninterrupted service. We may change or remove features. If we close the service we will give account holders reasonable notice so that projects can be downloaded first.
12. Ending the agreement
You can stop using AdBatch at any time and ask us to delete your account. We may suspend or close an account that breaks these terms, after telling you why where that is practical.
13. Disclaimer
AdBatch is provided “as is”. To the extent the law allows, we make no warranties, express or implied, including that the service will meet your needs, be error-free, or that ads made with it will be accepted by any platform or produce any result.
14. Limit of liability
To the extent the law allows, Agent Creative is not liable for indirect, incidental or consequential losses, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the amount you paid us in the twelve months before the claim, or 50 US dollars if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.
15. Governing law
These terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in Connecticut, unless the law where you live gives you the right to bring a claim at home.
16. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change is significant we will say so on the site or by email. Continuing to use AdBatch after a change means you accept the new terms.
