Terms of Service
The agreement between you and Agent Creative for using QuoteKit.

These terms are an agreement between you and Agent Creative (“we”, “us”), the operator of QuoteKit. By creating an account or using QuoteKit you agree to them. If you do not agree, please do not use the service.
1. What QuoteKit is
QuoteKit lets a contractor build an estimate, send it to a customer as a link, and record the customer’s approval, change request or decline. It is a quoting tool. It does not collect payments from your customers, issue invoices, schedule work, or give legal, tax or accounting advice.
2. Accounts
- You can try the builder without an account. You need an account to save, send or export a quote.
- You must give a working email address and keep your password to yourself. You are responsible for what is done through your account.
- You must be at least 18 and able to enter into a contract to open an account.
3. Plans, billing and canceling
- The plans and their prices are listed on the Pricing page. The Free plan allows a limited number of new quotes each calendar month.
- Paid plans are billed monthly in advance through Stripe and renew each month until canceled.
- You can cancel at any time. Your paid features stay on until the end of the period you have paid for, and the account then returns to the Free plan. Your saved quotes and signed records remain.
- Except where the law requires otherwise, payments already made are not refunded for part-months.
- If we change a plan’s price, we will tell you before the change applies to your next renewal, and you can cancel before it does.
4. Your quotes and your customers
- Your quotes, prices, business details and customer records are yours. You give us permission to store and display them only as needed to run the service for you.
- You are responsible for the content of your quotes: the prices, the scope, the tax you charge, the terms you offer, and whether you hold the licenses your trade requires.
- You must have the right to use the customer details you enter, and you must send a quote’s link only to the customer it is meant for. Anyone who has the link can open that quote.
- The trade templates contain placeholder prices. They are starting points, not recommendations of what to charge.
5. Approvals and signatures
When a customer approves a quote, QuoteKit records the typed name, the signature, the amount, the date and time, and the IP address, and locks the quote. That record is evidence of what the customer did on the page. The agreement itself is between you and your customer. We are not a party to it, and we make no promise that an approval recorded through QuoteKit meets the legal requirements for a contract in your state or for your type of work. Where the law requires specific contract wording, notices or cancellation rights, providing them is your responsibility.
6. Acceptable use
You agree not to use QuoteKit to send quotes to people who have not asked for them, to mislead customers about who you are, to break the law, to try to access another account’s data, or to interfere with the service. We may suspend an account that does.
7. Availability and changes
We work to keep QuoteKit available and accurate, but it is provided “as is” and “as available”. It may be interrupted for maintenance or by things outside our control, and features may change. If we ever retire the service we will give reasonable notice so you can print or export your quotes.
8. Checking your numbers
QuoteKit calculates totals in whole cents from the figures you enter, and shows you the result before you send it. You are responsible for checking a quote before it goes out. We are not responsible for a job priced too low or too high because of figures entered into the tool.
9. Limits of liability
To the fullest extent the law allows, Agent Creative is not liable for lost profits, lost jobs, lost data, or any indirect or consequential loss arising from your use of QuoteKit, and our total liability for any claim is limited to the amount you paid us for the service in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
10. Privacy
The Privacy Policy explains what is stored about you and about customers who open your quotes.
11. Ending the agreement
You can stop using QuoteKit and ask us to close your account at any time. We may close an account that breaks these terms. When an account is closed, its quotes, profile and price book are deleted.
12. Governing law
These terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Connecticut.
13. Changes to these terms
We may update these terms. If a change is significant we will update the date at the top and post the new version here. Continuing to use QuoteKit after a change means you accept the updated terms.
